Conditions générales de vente

Welcome to MIAWOU.

These General Terms and Conditions of Sale (“Terms and Conditions”) govern the contractual relationship between MG-Com, operator of the MIAWOU website, and any person making a purchase on the website (the “Customer” or “you”).

The MIAWOU website offers wellness and comfort products for individual consumers.

By placing an order on our website, you acknowledge that you have read and accepted these Terms and Conditions without reservation.

These Terms and Conditions are available at any time on the website and apply to all orders placed through it.

MIAWOU uses the Shopify platform to operate its online store.

ARTICLE 1 – SELLER IDENTIFICATION

The MIAWOU website is operated by:

MG-Com

Email: contact@miawou.com

The website is operated by a professional established in the European Union and markets its products to consumers, including consumers located in France.

ARTICLE 2 – WEBSITE ACCESS AND USE

Use of the MIAWOU website is available to persons with the legal capacity to enter into a contract.

The Customer agrees to provide accurate, complete, and up-to-date information when creating an account or placing an order.

The Customer is responsible for keeping their login credentials confidential and for all activity carried out through their account.

It is prohibited to sell, transfer, or assign an account to a third party.

ARTICLE 3 – PRODUCTS

The products offered for sale are described and presented as accurately as possible.

Photographs, illustrations, and graphical representations of products are provided for illustrative purposes. Slight differences in color or appearance may result from the settings of the screen used by the Customer.

The essential characteristics of each product are presented on the product page before the order is validated.

MIAWOU reserves the right to modify the presentation, characteristics, or availability of its products at any time, without affecting orders that have already been validated.

ARTICLE 4 – ORDERS

The Customer may place an order directly through the MIAWOU website.

Before confirming an order, the Customer may review its contents, the total price, any applicable shipping fees, and correct any errors.

Final confirmation of the order implies an obligation to pay.

The order becomes final once payment has been validated and the order has been confirmed by MIAWOU.

A confirmation email will then be sent to the email address provided by the Customer.

MIAWOU reserves the right to refuse or cancel an order for a legitimate reason, including suspected fraud, an obvious error concerning the price or product, a payment issue, or exceptional product unavailability.

If an already-paid order is cancelled, the corresponding amounts will be refunded to the Customer.

Products purchased are intended for personal use and not for professional resale, unless otherwise agreed in advance with MIAWOU.

ARTICLE 5 – PRICES

Prices displayed on the website are stated in euros and include applicable taxes where such taxes are due.

The applicable price is the price displayed at the time the order is confirmed.

Any applicable shipping fees will be displayed to the Customer before final confirmation of the order.

MIAWOU reserves the right to modify its prices at any time. However, no price change will apply to an order that has already been validated.

Promotional offers are valid for the period indicated and subject to product availability, unless otherwise stated.

ARTICLE 6 – PAYMENT

Payment is made using the payment methods offered on the website at the time the order is placed.

The Customer guarantees that they have the necessary authorization to use the selected payment method.

Payment transactions are secured by the payment service providers used by MIAWOU and/or Shopify.

The order will only be processed after effective confirmation of payment, unless otherwise stated.

ARTICLE 7 – DELIVERY

Orders are shipped according to the terms described in our Shipping Policy.

Delivery times displayed on the website are estimates. MIAWOU makes every effort to meet the stated delivery times.

In the event of a delivery delay, the Customer has the rights provided under applicable regulations.

Under French consumer law, when the seller fails to deliver the goods on the agreed date or within the agreed period, the consumer may, in particular, request that the seller make the delivery within a reasonable additional period and, under certain conditions, terminate the contract.

MIAWOU cannot be held liable for delays resulting from unforeseeable circumstances or circumstances beyond its control, subject to applicable legal provisions.

The transfer of risk takes place in accordance with applicable regulations governing sales to consumers.

ARTICLE 8 – RIGHT OF WITHDRAWAL

In accordance with the provisions of the French Consumer Code applicable to distance contracts, consumer Customers have a legal period of 14 days to exercise their right of withdrawal without having to provide a reason.

For goods, this period begins on the day after the product is received.

A Customer wishing to exercise their right of withdrawal must notify MIAWOU of their decision before the expiry of the legal period.

The request may be sent to:

contact@miawou.com

The Customer must then return the product in accordance with the instructions provided by MIAWOU.

The product must be returned in a condition allowing it to be resold, subject to the consumer's legal right to handle and inspect the product within the limits provided by law.

When the right of withdrawal is validly exercised, MIAWOU will refund the amounts due in accordance with applicable regulations.

The refund includes the initial standard delivery costs, under the conditions provided by law.

The refund may be postponed until the product has been recovered or until the Customer provides proof of shipment, whichever occurs first.

Return shipping costs are covered in accordance with our Return & Refund Policy and the conditions communicated to the Customer.

ARTICLE 9 – 90-DAY COMMERCIAL RETURN POLICY

In addition to the statutory 14-day right of withdrawal, MIAWOU offers a commercial return policy of up to 90 days from receipt of the product, subject to the conditions set out in our Return & Refund Policy.

This 90-day commercial return policy is an additional benefit offered by MIAWOU and in no way limits the legal rights available to consumers, including their statutory right of withdrawal and legal guarantees.

Detailed terms are available in our Return & Refund Policy.

ARTICLE 10 – LEGAL GUARANTEES

Products sold to consumers benefit from the applicable statutory guarantees, including:

  • the statutory legal guarantee of conformity;
  • the statutory guarantee against hidden defects.

These guarantees apply independently of any commercial warranty that may be offered by MIAWOU.

If a product has a lack of conformity or a hidden defect, the Customer may contact our customer service at:

contact@miawou.com

MIAWOU undertakes to process such requests in accordance with applicable legal provisions.

ARTICLE 11 – DAMAGED OR NON-CONFORMING PRODUCTS

The Customer is encouraged to inspect their package and product upon receipt.

In the event of a damaged, defective, non-conforming product, or any other issue, the Customer should contact MIAWOU as soon as possible so that the situation can be reviewed.

This request in no way limits the Customer's rights under applicable statutory guarantees.

ARTICLE 12 – INTELLECTUAL PROPERTY

All elements appearing on the MIAWOU website, including texts, photographs, images, videos, graphics, logos, trademarks, illustrations, designs, editorial content, and graphical elements, are protected by applicable intellectual property laws.

The MIAWOU trademark and associated elements may not be used without prior authorization.

ARTICLE 13 – THIRD-PARTY TOOLS AND SERVICES

The website may integrate features or services provided by third-party providers, including payment, delivery, analytics, customer review, or other services necessary for the operation of the website.

Use of these services may be subject to the terms and privacy policies of their respective providers.

MIAWOU cannot be held liable for malfunctions directly attributable to a third-party provider, subject to its legal obligations as a seller.

ARTICLE 14 – LINKS TO THIRD-PARTY WEBSITES

The website may contain links to websites or services operated by third parties.

MIAWOU is not responsible for the content, operation, or practices of these third-party websites.

Any use of such websites is subject to the terms applicable to their respective operators.

Personal data collected when using the website or placing an order is processed in accordance with our Privacy Policy.

Information concerning the collection, use, retention, and rights of users is detailed in this policy.

The website uses Shopify for its technical operation and may use various service providers necessary for order processing, payments, delivery, customer service, and website management.

ARTICLE 16 – CUSTOMER COMMENTS AND REVIEWS

When the Customer publishes a comment or review on the website, they guarantee that they have the necessary rights to publish such content.

The Customer agrees not to publish any content that is illegal, defamatory, misleading, offensive, or that infringes the rights of a third party.

MIAWOU reserves the right to remove any content that is clearly contrary to the law or these Terms and Conditions.

Customer reviews may be used in accordance with applicable consumer protection and review transparency regulations.

ARTICLE 17 – ERRORS AND OMISSIONS

Despite the precautions taken to ensure the accuracy of the information provided on the website, certain typographical errors or omissions may occasionally occur.

In the event of an obvious error concerning, in particular, a price, product characteristic, or availability, MIAWOU reserves the right to correct the relevant information.

Where permitted by law and where an order is affected by an obvious error, MIAWOU may contact the Customer to find an appropriate solution.

  • disrupting the normal operation of the website.

ARTICLE 19 – LIABILITY

MIAWOU is responsible for the proper performance of the obligations arising from the sale.

MIAWOU cannot be held liable for damage resulting from an event of force majeure or an external cause that cannot be attributed to it, subject to mandatory applicable legal provisions.

Nothing in these Terms and Conditions is intended to limit or exclude any rights legally granted to consumers.

ARTICLE 20 – TERMINATION AND CUSTOMER ACCOUNT

The Customer may request closure of their customer account at any time, subject to any contractual or legal obligations that may continue to apply to previously placed orders.

MIAWOU may suspend or close an account in the event of fraudulent, abusive, or non-compliant use of the website, subject to the Customer's rights and applicable legal provisions.

ARTICLE 21 – PARTIAL INVALIDITY

If any provision of these Terms and Conditions is declared invalid, unlawful, or unenforceable, the remaining provisions will remain fully applicable.

The relevant provision will, where possible, be interpreted or replaced in accordance with applicable legal rules.

ARTICLE 22 – NO WAIVER

The failure by MIAWOU to immediately exercise any right provided for under these Terms and Conditions does not constitute a waiver of that right.

ARTICLE 23 – CHANGES TO THE TERMS AND CONDITIONS

MIAWOU may modify these Terms and Conditions in order to reflect changes to the website, its services, or applicable regulations.

The version applicable to an order is the version accepted by the Customer at the time the order is confirmed.

The most recent version of the Terms and Conditions is available at any time on the website.

ARTICLE 24 – GOVERNING LAW AND DISPUTES

These Terms and Conditions are governed by applicable law, subject to mandatory consumer protection provisions applicable in the Customer's country of residence.

For consumers residing in France, mandatory provisions of French consumer protection law remain applicable where the relevant legal conditions are met.

In the event of a dispute, the Customer is invited to contact MIAWOU first in order to seek an amicable resolution.

If a complaint remains unresolved, the consumer may, subject to the applicable legal conditions, make free use of the consumer mediation procedure.
